Deciphering The Education Code: Translating Laws Into Sound Personnel Practices For Certificated And Classified Employees
Wednesday September 25, 2024 3:15pm - 4:15pm PDT
It has been noted that “entry into the Education Code is painful” and “large parts of the Education Code are not meant to be understood” – and this was the California Court of Appeal speaking. This session will break down the otherwise indecipherable provisions of the Education Code as it relates to the fundamental rules of certificated and classified employment. Targeted for both emerging and advanced HR practitioners, we will cover fundamentals such as how the Education Code establishes the certificated and classified services, as well as advanced scenarios, such as the subtle yet significant distinctions in how the Education Code treats topics such as employee classifications, leaves of absences, seniority, permanent status, rehire rights, layoffs, and bumping with respect to certificated and classified personnel, as well as the interplay between Education Code rights and the collective bargaining process.

3 Key Audience Takeaways:
  1. Learn about the Education Code’s fundamental structure and architecture setting up school district employment classifications.
  2. Hear how the Education Code treats classified and certificated employees with respect to tenure, seniority, discipline, dismissal, layoff, and leaves.
  3. Walk through hypothetical scenarios demonstrating how tenure and seniority concepts are applied under the Education Code.

Are They a Jerk, or Is This a Unlawful Hostile Work Environment? Investigating Employee Bullying Complaints
Wednesday September 25, 2024 3:15pm - 4:45pm PDT
Bullying among students in the K-12 setting is hardly a new phenomenon but the increasing number of employee complaints about bullying is new. School district human resources professionals often face hurdles in investigating and analyzing employee bullying allegations. Most school districts do not have stand-alone bullying policies that pertain to employees, yet the complaints still come in and need to be investigated. It is often challenging to define bullying and distinguishing bullying from unlawful hostile work environment, unprofessionalism or legitimate business behaviors. This presentation will help HR professionals sort the wheat from the chaff by reviewing common bullying behaviors and find definitions in District policies, even when there is no separate policy. The training will provide tips for gathering relevant evidence and a framework within which administrators can analyze that evidence, make clear findings and ultimately determine what, if any personnel action is required as a result.

Building, Repairing and Strengthening Relationships throughout the Negotiations Process
Wednesday September 25, 2024 3:15pm - 4:45pm PDT
The negotiations process is full of opportunities to build or ruin relationships and trust. Come learn and share about how to establish a framework for negotiations that may build, repair and/or strengthen relationships between the Board, the negotiations team and professional associations partners.

Superintendents, lead negotiators and upper-level central office school district leaders must know the basics of negotiations and must consider how to lead their system through the process in a way that effectively manages the relational dynamics of collective bargaining. This should be done with intentionality and purpose. Leaders should take time to develop a plan for guiding their district through the negotiations process in a way that builds relationships and trust.
